Terms of Service

These terms govern every Proofbound engagement. Using the Proofbound platform, or paying any Proofbound quote or invoice that references these terms, constitutes acceptance of them. No signature is required.
1. Who we are, and the words we use
"Proofbound," "we," and "us" mean Ensembio, Inc., a Washington corporation doing business as Proofbound. "You" are the person or organization using our services — the account holder, or the client named on a quote or invoice. "The Work" is the book or related deliverable we produce for you.
We serve customers two ways, and some terms below apply to only one of them:
- Self-Serve Services — book generation you purchase and run yourself through the Proofbound platform, at published prices.
- Commissioned Work — a book or deliverable produced under a written quote or invoice describing the engagement, at a quoted fee.
Sections that apply to only one are marked. Everything else applies to both. Where a quote or invoice for Commissioned Work conflicts with these terms, the quote or invoice controls for that engagement.
2. What we do
We research, write, edit, design, and typeset the Work to the specifications you provide — subject, audience, length, named author, tone, format. Our services include content generation, editing, formatting, cover design, and publishing assistance. Print fulfillment, if included, is billed at quoted cost, with a firm quote before each order.
3. Accounts
Self-Serve ServicesTo use certain features you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. Your materials
You may supply source material — manuscripts, notes, transcripts, recordings, images. You confirm you own or have permission to use everything you supply, and that none of it is confidential to a third party, defamatory, or infringing. We may rely on your materials and instructions without independent verification.
5. Content guidelines
You agree not to submit content that:
- Violates any laws or regulations
- Infringes on intellectual property rights
- Contains malware or harmful code
- Violates privacy rights of others
We reserve the right to refuse service or remove any content for any reason at our sole discretion.
6. Fees and payment
Self-Serve ServicesOur services are offered under several tiers and add-ons. Current pricing — including tiers, printing, and add-ons — is published on our pricing page, and the prices published there at the time of purchase apply to your order. We may change our pricing with notice. Payment is processed through Stripe. The Book Pass is a fixed-term access pass, not a recurring subscription; it does not auto-renew.
Commissioned WorkFees are stated on your quote or invoice, which together with these terms forms the service agreement for your engagement. The creation fee for each title is due before work begins; print costs are invoiced at order placement. Included revision rounds are stated on the quote and must be requested within ninety days of first delivery of the complete proof; additional rounds are billed at the quoted rate. Amounts more than thirty days past due may pause work in progress.
7. Review and acceptance of the Work
You are the final editor. Before printing or publication, review the complete proof — every page, including facts, names, quotations, and attributions.
Commissioned WorkAny of the following constitutes acceptance of the Work: (a) your written approval; (b) your authorization of a print run or publication in any form; or (c) thirty days passing after delivery of the final proof without written objection. Acceptance is final.
Self-Serve ServicesOrdering a print run, downloading final files, or publishing the Work constitutes acceptance of it.
8. Rights and ownership
Your content. You retain all rights to the material you submit. You warrant that you have the right to submit it and that it does not infringe third-party rights.
The Work. Upon acceptance and full payment, we assign to you all right, title, and interest in the Work, worldwide and in perpetuity. Publish, sell, adapt, translate, or license it freely, with no further payment to us.
Our platform. Proofbound retains all rights to our platform, technology, and methodologies. You may not copy, modify, or reverse engineer our services.
Commissioned WorkWe retain the right to display the Work — cover and brief excerpts — in our portfolio and marketing, unless you ask us not to in writing. We do not display self-serve books in our marketing without your permission.
9. After acceptance, the Work is yours — entirely
Once you accept the Work, you assume sole responsibility for it: the accuracy of its contents; clearance of third-party rights (copyright, trademark, publicity, privacy); compliance with any law, regulation, or professional standard that applies to you; and all consequences of its publication, distribution, and use. Editorial assistance is not legal review — we do not verify facts, clear rights, or provide legal, financial, or compliance advice.
10. Indemnity
You will defend us and hold us harmless from any third-party claim, and the costs of defending it, arising from the contents of the Work, materials you supplied, your use of our services, your violation of these terms, or your publication or use of the Work after acceptance.
11. No warranty; limit of liability
After acceptance, the Work is provided as-is, with no warranty of any kind. Our total liability, on any theory, is limited to the fees you actually paid for the Work or service in question. Neither party is liable for indirect, incidental, special, or consequential damages, including lost profits.
12. Refunds
Self-Serve ServicesWe stand behind our work. If you are not satisfied with your book, we will work with you to address concerns. Refunds are considered on a case-by-case basis and may be provided at our discretion within 30 days of delivery. Fees are otherwise non-refundable.
Commissioned WorkFees already paid are not refunded, and fees for work already performed remain due.
13. Service availability
We strive to maintain high service availability but do not guarantee uninterrupted access. We may suspend or terminate services for maintenance, security, or other operational reasons.
14. Ending an engagement
Self-Serve ServicesEither party may terminate at any time. Upon termination your access to our services will cease, but you retain rights to any books already delivered to you.
Commissioned WorkEither party may end an engagement with thirty days' written notice. You receive all work completed to date; fees already paid are not refunded, and fees for work already performed remain due.
Each party keeps the other's non-public information confidential, during and after the engagement.
15. Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.
16. Governing law and disputes
Washington law governs these terms, without regard to conflict of law principles. Venue for any dispute is King County, Washington.
17. General
These terms, together with your quote or invoice, are the entire agreement for the engagement and replace prior discussions. Changes require a writing agreed to by both parties, except that we may modify these terms for the Self-Serve Services with notice of significant changes; continued use after a change constitutes acceptance. If any term is found unenforceable, the rest remain in effect.
